Kazmir Terms & Conditions (including Waiver & Client Agreement)

1. Definitions

1.1 In these terms and conditions, "Kazmir" means Busra Kazmir operating under the registered business name Kazmir, located at Box D8412 Keurenplein 41, 1069CD Amsterdam, Nederland, registered in the Dutch Chamber of Commerce under number 88034615.

1.2 In these terms and conditions, "client" or "customer" means the company or person who commissions Kazmir to perform any of its offered services or purchases any of the services offered by Kazmir.

1.3 In these terms and conditions "service(s)" means all services offered by Kazmir online and physically, including but not limited to coaching, memberships, digital products, and community access.

1.4 In these terms and conditions "parties" means Kazmir and the client/customer.

1.5 "Coaching trajectory" means the structured program of sessions as outlined in packages (3, 4, or 6 months) including but not limited to individual sessions, exercises, and meditations as specified per package.

1.6 "Business client" means any client purchasing services for business purposes, through a company entity, or claiming business tax deductions for the services.

1.7 "Individual client" means any client purchasing services for personal development purposes as a private individual.

1.8 "Digital Platform" means all digital services, platforms, and offerings provided by Kazmir through online or digital means, including but not limited to memberships, online courses, community platforms, digital downloads, live virtual events, and group sessions.

1.9 "Coaching Services" means individual coaching sessions, whether conducted online or in-person.

1.10 "Healing Services" means individual energetic healing sessions, including but not limited to energy-based practices, whether conducted online or in-person.

2. Applicability

2.1 These terms and conditions apply to all offers, quotations, work, treatments, assignments, services and agreements between Kazmir and the customer. By entering into the foregoing, the customer has declared to give legal force to and agree with these terms and conditions.

2.2 These terms and conditions also apply if third parties are involved by Kazmir in the offers, quotations, work, treatments, assignments, services and agreements.

2.3 If one of the provisions of these terms and conditions is found to be invalid or unreasonably onerous, this will not affect the validity of the entire terms and conditions but only the provision in question.

2.4 Specific provisions may apply differently to business clients versus individual clients as outlined throughout these terms.

3. Disclaimer of Medical or Professional Status

Busra Kazmir is not a licensed therapist, medical doctor, psychologist, counselor, or any other regulated healthcare or mental health professional. She does not claim to hold such qualifications. Kazmir operates exclusively as a personal development coach and all services are provided in that capacity only.

4. Nature of Services

Nature of Services Services provided by Kazmir may include coaching, NLP, hypnosis, guided meditation, energy-based or intuitive practices, and somatic or subconscious techniques. These services are strictly non-medical, non-diagnostic, and intended solely to support personal insight, emotional balance, and self-development. All services are delivered on a best-effort basis only. Kazmir explicitly does not guarantee specific outcomes, transformations, or results. No promises of therapeutic, medical, psychological, or life-changing effects are made or implied.

5. Client Responsibility

You accept full responsibility for your emotional and physical well-being before, during, and after sessions. You agree to participate respectfully and consciously, and to ensure that anyone with whom you share session content also takes full responsibility for their experience. You are fully responsible for all content you share, post, or communicate within any Kazmir platform or service, and these Terms & Conditions apply to all your participation and interactions. The services offered expressly do not replace professional medical, psychological, or legal treatment. You are fully responsible for your own decisions and actions resulting from the services provided.

5.1 Digital Product Responsibility: You are fully responsible for downloading and safely storing all digital products within the specified timeframe. Kazmir provides reasonable notice and support for download processes but cannot guarantee indefinite availability.

5.2 Mental Health Considerations: If the client has psychiatric conditions, personality disorders, or other serious mental health conditions, the client is advised to continue professional treatment with a licensed mental health specialist alongside coaching services. Coaching is not therapy and cannot replace professional mental health treatment. Kazmir reserves the right to discontinue services if specialized mental health intervention is clearly required.

5.3 Login Credentials Security: Clients are fully responsible for maintaining the security of any login credentials provided by Kazmir. Sharing credentials with third parties is strictly prohibited. If Kazmir detects unauthorized access due to credential sharing, access will be immediately revoked without refund.

6. Medical Supervision

You are responsible for informing your physician, therapist, or other care providers before applying any tools or techniques presented in the sessions, and for remaining under their supervision if applicable.

7. Ongoing Care

You agree to continue taking any prescribed medications and to stay under appropriate medical or psychological care where required.

8. Appropriate Use of Services

You agree not to use these services as a substitute for urgent or critical medical, psychiatric, or legal needs, or in any context where professional intervention is clearly required.

9. Age Requirements

All services and memberships are intended for individuals aged 18 and older. Minors (under 18) may only participate with explicit written consent from a parent or legal guardian, who must also accept these terms on their behalf.

10. Formation of Agreement

10.1 An agreement between Kazmir and the customer is established by offer and acceptance.

10.2 Acceptance occurs by sending written confirmation, payment completion, or when Kazmir commences performance of services.

11. Payment Terms

11.1 For coaching trajectories, payment may be made in installments as specified in the package agreement. For digital products and single sessions, payment must be completed before accessing services or content.

11.2 All invoices have a 14-day payment period from invoice date.

11.3 Payment will be made by bank transfer to the IBAN number specified by Kazmir or through designated payment platforms.

11.4 Prices and VAT: All prices are exclusive of VAT unless explicitly stated otherwise or required by law. Applicable VAT will be added at the time of invoicing, based on the relevant tax regulations and the customer's country of residence. Any different agreement between the parties will prevail.

11.5 Failed payments may result in immediate suspension of access until payment is resolved.

11.6 Chargebacks or payment disputes may result in permanent termination of access to all services and content, without refund.

11.7 Payment processing fees are non-refundable.

11.8 The customer is obliged to pay in full and on time.

11.10 Invoice Disputes: Any disputes regarding invoices must be submitted in writing within 5 days of the invoice date. Disputes do not suspend the client's payment obligation.

12. Release of Liability & Limitation of Liability

12.1 You accept full responsibility for any outcomes that result from participating in sessions, and you waive any liability claims against Busra Kazmir and/or Kazmir. This includes claims made by yourself or by others whom you may attempt to help using tools introduced during your sessions.

12.2 Kazmir is not responsible for any collaborations, co-creations, business partnerships, or other relationships that may develop between participants. Any agreements, projects, or ventures arising from connections made through Kazmir services are solely between the participating individuals.

12.3 Kazmir is not liable for indirect damages, including lost profits, delay damages, consequential damages, and trading loss.

12.4 Kazmir is not liable for consequences and (mental) damages resulting from and related to personal experiences and results by taking services or participating in programs.

12.5 Kazmir is only liable if the customer can sufficiently prove that Kazmir has not fulfilled its obligations of effort. In such cases, liability is limited to the amount paid for that specific service or product.

12.6 Claims Limitation: All claims, demands and entitlements must be submitted to Kazmir within twelve (12) months of the service being performed. After this period, the customer's right to compensation will lapse entirely.

13. Technical Disclaimer

13.1 Kazmir is not responsible for technical issues including but not limited to: internet connectivity problems, platform outages, audio/video quality issues, or any technical failures that may interrupt or affect your session experience. No refunds will be provided for technical disruptions.

13.2 Technical Support Commitment: While Kazmir cannot control all technical factors, we commit to:

14. Refunds & Scheduling

14.1 Individual Client Cooling-off Period: Individual clients (non-business) may cancel services within 7 days of purchase without penalty, provided services have not yet commenced and digital products have not been accessed.

14.2 Business Client Policy: Business clients are subject to the no-refund policy - all sales are final once purchased.

14.3 Cancellation Fees:

14.4 Rescheduling is possible with at least 24 hours' notice and subject to availability.

14.5 Partially used packages are non-refundable and must be used within the timeframes specified in clause 14.7.

14.6 No-shows will be charged 100% of the service fee.

14.7 Coaching Trajectory Timeframes: Coaching trajectories must be completed within the following time frames:

Unused sessions beyond these timeframes expire unless otherwise agreed in writing.

14.8 Waiver of Right of Withdrawal (EU Law)

For digital products that are delivered immediately after purchase, the client expressly agrees to begin access upon purchase and waives their right to the 14-day withdrawal period in accordance with Article 6:230p BW of the Dutch Civil Code and EU consumer law.

14.8.1 Global No-Refund Policy for Instant Access Digital Products:
By purchasing any digital product (including but not limited to courses, meditations, downloads, audio, video, PDFs), you acknowledge and agree that the product is delivered immediately upon purchase. Due to the nature of digital goods, all sales are final and non-refundable, regardless of jurisdiction. This applies to clients worldwide, including those located in the EU, United States, Canada, Australia, and the UK.

14.8.2 Consent to Immediate Access:
By completing your purchase, you expressly agree that access to the product or service begins immediately. You waive any and all rights to a withdrawal period, cancellation, or refund, as allowed under applicable consumer laws, including Article 6:230p BW of the Dutch Civil Code and other international equivalents.

14.8.3 Technical Issues & Replacement Policy:
In the event of technical difficulties, Kazmir will provide reasonable support and, if verified, reissue the purchased digital product once within 6 months of purchase. This does not constitute a basis for refund.

15. Default & Late Payment

15.1 If the customer fails to make timely payment, Kazmir will give written notice and fourteen (14) days to make payment, after which statutory interest and collection costs will be charged.

15.2 Continued non-payment may result in suspension of all services and legal action.

16. Confidentiality & Privacy

16.1 Mutual Confidentiality: All session-related information is treated as confidential. However, full confidentiality in group settings cannot be guaranteed.

16.2 Group Settings: By participating in group sessions (including the Digital Platform), you agree to respect others' privacy and not record, share, or disclose any information without written consent.

16.3 Breach Consequences: Violation of confidentiality may result in immediate termination of services without refund and potential legal action for damages.

16.4 Emergency Exception: In cases of imminent danger to the client or society, Kazmir reserves the right to break confidentiality and inform relevant authorities.

16.5 Privacy and Data Protection

Kazmir processes personal data in accordance with applicable privacy laws, including the General Data Protection Regulation (GDPR). For detailed information on how your personal data is collected, used, and protected, please refer to our separate Privacy Policy, which is available on our website at https://www.busrakazmir.com/privacy-policy 

By accepting these Terms & Conditions, you also consent to the processing of your personal data as described in the Privacy Policy.

17. User Account and Platform Use

If you create an account or profile on any Kazmir platform, you are responsible for safeguarding your login credentials. You agree not to post unlawful, harmful, or infringing content. You are fully responsible for all content, communications, and materials you share or post on any Kazmir platform or service. Kazmir reserves the right to remove content or terminate access at its discretion.

18. Intellectual Property & Penalties

18.1 Ownership: All content and materials shared by Kazmir (including meditations, downloads, audio, video, graphics, and written work) remain the sole property of Kazmir.

18.2 Prohibited Use: You may not copy, sell, share, alter, distribute, or re-use any content without written permission.

18.3 IP Violation Consequences: Violation of intellectual property rights will result in immediate termination of services without refund and potential legal action for damages and injunctive relief.

18.4 Digital Products: All digital content is for private use only. Sharing, selling, or reusing in any form is strictly prohibited.

18.5 Enhanced Digital Download Policy:

18.6 Social Media Sharing Policy: Clients may only create screenshots or recordings of sessions for personal use and limited social media sharing with prior written consent from Kazmir. For 1-on-1 sessions, consent may be requested per session. For Digital Platform community sessions, prior consent is always required for any recording or screenshot. Any content shared on social media must include proper attribution to Kazmir (@busrakazmir) and may not exceed 30 seconds of audio/video content. Sharing must be respectful and may not misrepresent Kazmir's methods or create false impressions about services offered.

19. Memberships & Subscriptions (Digital Platform)

19.1 Subscription Terms: Memberships may be offered monthly or with "lifetime" access. Monthly memberships grant access for 30 days from payment date and renew automatically unless cancelled.

19.2 Lifetime Access Clarification: "Lifetime" access refers to access for as long as Kazmir continues to offer the service commercially. Kazmir will provide at least 30 days notice before discontinuing any service with "lifetime" access, and will offer alternative arrangements where possible including: transfer to similar service, partial refund calculation, or extended access to archived content.

19.3 Subscription Termination: Monthly memberships can be cancelled at any time with one month's notice. Cancellation will take effect at the end of the current billing period. No minimum term applies to monthly memberships.

19.4 Price Changes: Kazmir may adjust pricing, structure, or benefits with 30 days advance notice. For rate increases exceeding 15% annually, existing clients may complete their current package at the original rate.

19.5 Community Conduct: Violation of community guidelines may result in removal from the Digital Platform without refund.

19.6 Platform Responsibility: Kazmir only facilitates customer interaction. Customers bear full responsibility and risk for decisions and actions through the Digital Platform.

20. Third Parties

20.1 Kazmir may involve third parties in service delivery without customer consent.

20.2 Kazmir is not liable for damages caused by third-party acts or omissions.

21. Insurance & Medical Claims

It is the customer's responsibility to verify insurance coverage and claim reimbursements from their insurer.

22. Rate Changes

22.1 Rates are valid for one calendar year and may be adjusted annually.

22.2 For reasonable cause (inflation, cost increases), rates may change during the year with 30 days notice to customers.

22.3 All rate changes will be communicated with specific percentage increases and effective dates.

23. Indemnification

You agree to indemnify and hold harmless Busra Kazmir, Kazmir, and affiliated parties against any claims, damages, or losses arising from your misuse of the services, platform, or breach of terms.

24. Complaints & Dispute Resolution

24.1 In case of dissatisfaction, customers must notify Kazmir in writing within 7 days of the incident. Include specific details about the nature of the complaint.

24.2 Kazmir will acknowledge receipt within 2 business days and respond with a resolution proposal within 7 business days.

24.3 For complex issues requiring investigation, clients will receive progress updates every 5 business days.

24.4 If the complaint cannot be resolved through direct communication, either party may seek mediation or arbitration as outlined in section 31.

25. Force Majeure

Kazmir is not responsible for delays or failure in performance caused by circumstances beyond reasonable control, such as natural disasters, wars, strikes, or technical failures.

26. Termination of Agreement

26.1 Agreements end by operation of law when services are completed.

26.2 For multi-phase services, if Kazmir terminates for reasons not related to client breach of terms, unused services may be eligible for partial refund at Kazmir's discretion.

26.3 Either party may terminate for: non-payment, repeated breach of terms (more than twice), or violation of behavioral/ethical standards.

27. Updates to Terms

27.1 Kazmir reserves the right to update these terms with 30 days written notice to active clients.

27.2 Significant changes affecting pricing, service delivery, or liability will require explicit client consent.

27.3 Clients may terminate their agreement within 14 days of receiving notice of material changes without penalty.

27.4 Continued use of services after the notice period constitutes acceptance of updated terms.

28. Platform Flexibility & Final Authority

28.1 Kazmir retains full discretion to update, change, pause, discontinue, or restructure any offer, product, or membership.

28.2 No entitlement arises from previous access, pricing, or terms.

29. Free Public Content

All free content (social media, newsletters) is subject to change or removal at any time without notice.

30. Assignment and Transfer

30.1 Clients may not assign, transfer, or delegate any rights or obligations under this agreement without prior written consent from Kazmir.

30.2 Kazmir may assign this agreement to affiliated entities or in case of business transfer, with appropriate notice to clients.

30.3 Any attempted unauthorized assignment by the client shall be void and may result in immediate termination of services.

31. Jurisdiction and Governing Law

31. Jurisdiction and Governing Law These Terms & Conditions shall be governed exclusively by the laws of the Netherlands. All disputes arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands.

31.1 International Clients Agreement By engaging Kazmir’s services from outside the Netherlands, the client expressly agrees that all claims, disputes, and legal matters will be governed solely by Dutch law and resolved exclusively by the courts of Amsterdam, the Netherlands. The client irrevocably waives any right to initiate or participate in legal proceedings in any other jurisdiction or under any foreign legal system.
